Policy

This draft focuses on a "Limited Liability" and "Shared Responsibility" model. It clarifies that while you implement security measures, the ultimate responsibility for data ownership and legal compliance remains with the client.

Privacy Policy & Limitation of Liability

Effective Date: April 5, 2026

Service Provider: Infrapulse Solutions Pvt Ltd (“The Consultant” / “I” / “Me” / "We")

1. Scope of Services

We provide infrastructure, security, and compliance consultancy services to individuals and organisations. These services are performed on a contract or person-to-person basis. This policy governs how I handle information provided to us during these assignments.

2. Information Collection & Use

  • Personal Requests: We may collect only the minimum data necessary (name, contact info, billing details) to fulfil the service.

  • Organisational Requests: We may require access to system logs, network configurations, or administrative credentials. This data is used strictly for the purpose of executing the contracted technical work.

3. Data Ownership & Responsibility

  • Client Ownership: All data processed, hosted, or managed within the client's infrastructure remains the sole property of the Client.

  • Compliance Responsibility: It is the Client’s responsibility to ensure that their data collection and storage practices comply with local laws (e.g., Digital Personal Data Protection Act). We act as a technical consultant, not a data controller.

4. Security & Best Practices

While we implement industry-standard security protocols (including firewall hardening, encryption, and access controls), the Client acknowledges that no system is 100% secure. Our role is to provide recommendations and technical implementation based on current expertise.

5. Disclaimer & Limitation of Liability

This is the critical section for your protection:

  • No Liability for Data Loss: We shall not be held liable for any loss of data, corruption of files, or system downtime that occurs during or after the provision of services.

  • Third-Party Breaches: We are not responsible for security breaches resulting from third-party software vulnerabilities (e.g., OS bugs, hardware failures, or ISP issues).

  • Indirect Damages: In no event shall Infrapulse Solutions Pvt Ltd be liable for any indirect, incidental, or consequential damages (including loss of profits) arising from the use of our services.

  • Client Negligence: Liability is waived if a security incident occurs due to the client’s failure to follow provided security recommendations or shared administrative credentials.

6. Confidentiality

We commit to maintaining strict confidentiality regarding the Client’s internal network architecture and business processes. No client data will be shared, sold, or used for marketing purposes without explicit written consent.

7. Changes to Terms

As a startup, we reserve the right to modify this policy to reflect changes in our service model. Continued engagement after updates constitutes acceptance of the new terms.
